1. Acceptance of Terms
By accessing or using the services provided by Lumix Solutions ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.
These Terms apply to all users, including customers, visitors, and anyone who accesses or uses our web hosting services, APIs, websites, and related products.
2. Service Description
Lumix Solutions provides web hosting and related services, including but not limited to:
- Shared, VPS, and dedicated server hosting
- Domain registration and DNS management
- DDoS protection and mitigation
- Website management tools and control panels
- Technical support and maintenance
- Backup and disaster recovery services
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected customers.
3. Account Registration
To use our services, you must:
- Be at least 18 years of age or the legal age of majority in your jurisdiction
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized account access
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. Acceptable Use Policy
You agree NOT to use our services to:
- Host, transmit, or distribute illegal content
- Engage in spamming, phishing, or malware distribution
- Conduct DDoS attacks or other malicious network activities
- Infringe on intellectual property rights of others
- Host content involving child exploitation
- Engage in cryptocurrency mining without explicit permission
- Circumvent security measures or access unauthorized systems
- Resell services without authorization
- Violate any applicable laws or regulations
⚠ Violations may result in immediate service termination without refund and may be reported to law enforcement.
5. Payment Terms
Billing
- Services are billed according to the selected plan (monthly, annually, etc.)
- All prices are in USD unless otherwise specified
- Applicable taxes will be added based on your location
- Payment is due at the beginning of each billing cycle
Late Payments
- Services may be suspended after 7 days of non-payment
- Accounts may be terminated after 30 days of non-payment
- Data may be deleted 14 days after termination
Refund Policy
New customers may request a refund within 30 days of initial purchase. Refunds are not available for domain registrations, setup fees, or services already rendered.
6. Service Level Agreement (SLA)
We strive to maintain 99.9% uptime for our hosting services. Our SLA terms:
- Network uptime guaranteed at 99.9% monthly
- Scheduled maintenance excluded from uptime calculations
- Credits issued for verified downtime exceeding SLA
- Claims must be submitted within 7 days of incident
99.9% - 99.0% = 10% credit
99.0% - 95.0% = 25% credit
Below 95.0% = 50% credit
Maximum credit per month is 50% of monthly service fee. Credits are applied to future invoices and are not redeemable for cash.
7. Data and Backups
Your Responsibility: You are solely responsible for maintaining backups of your data. While we may provide backup services, these are offered as a convenience and should not be your only backup.
No Liability: We are not responsible for any data loss due to hardware failure, software issues, security breaches, account termination, or any other cause.
Data Portability: You may export your data at any time through standard tools and methods provided with your service.
8. Intellectual Property
Your Content: You retain ownership of all content you host on our services. By using our services, you grant us a limited license to host, transmit, and display your content as necessary to provide the services.
Our Property: Lumix Solutions, our logos, trademarks, website content, and software are our intellectual property. You may not use these without our written permission.
DMCA: We respond to valid DMCA takedown notices. Repeat infringers will have their accounts terminated.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Services are provided "AS IS" and "AS AVAILABLE"
- We make no warranties, express or implied, regarding the services
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
- We are not liable for any third-party content hosted on our services
10. Indemnification
You agree to indemnify, defend, and hold harmless Lumix Solutions and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your content hosted on our services
- Your violation of any third-party rights
11. Termination
By You: You may terminate your account at any time through the control panel or by contacting support. Refunds are subject to our refund policy.
By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activity, or fail to pay for services.
Effect of Termination: Upon termination, your right to use the services ceases immediately. We may delete your data after a reasonable retention period.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes through email or our website. Continued use of services after changes constitutes acceptance of the modified Terms.
